Estates and Trusts Administration

We regularly advise executors, trustees and beneficiaries on the administration of estates, including compelling passings of accounts and responding to requests from upset beneficiaries. We have experience on applications for directions, rectifications and the wind-up of estates and trusts, including the final passings of accounts.

Guardianship and Consent and Capacity Law

We regularly assist clients dealing with incapable family members including on guardianship matters, disability issues and proceedings under the Adult Protection Act. Members of our team were counsel on the leading case on guardianship of the person in Newfoundland and Labrador and we have significant experience navigating this complex area of law, including in relation to issues of the rights of the alleged incapable. We have experience advising individuals and institutions on contested guardianship applications, including where there is a disagreement as to who should be the guardian; where there are allegations of breach of trust; and on matters related to fiduciary accounting and passings of accounts.

Vulnerable Persons Advocacy

Vulnerable persons advocacy is a key tenet of Saunders Collins & Loeb Law. Our lawyers are dedicated to the development of the law in Newfoundland and Labrador, including where it comes to representation of those where capacity is in issue, including older adults, those suffering from mental health issues, minors and their advocates whose interests are before the Court or subject to government action. We have experience in challenging legislation and ensuring that government action is lawful. Our firm offers pro bono legal services for special projects involving these issues.
